Agreement
These Terms of Service are an agreement between you and Zaleeka (“Zaleeka”, “we”, “us”) covering zaleeka.com and the Zaleeka service. By using the site or service, or by starting a pilot or subscription, you agree to these terms. If you use the service for a business, you confirm you can bind that business.
The service
Zaleeka lets people who see your website, social pages, QR codes, print, signage and broadcast advertising ask questions and become inquiries, and delivers those inquiries to you with their source. Zaleeka is built on Instant Inquiries technology and platform.
Eligibility
The service is for businesses and people 18 or older.
Pilot, plans and payment
The pilot costs $499 setup and $198 a month for 3 months, plus applicable taxes, and does not renew automatically. Plans are billed monthly in advance at the price shown when you subscribe, plus applicable taxes. Minute allowances reset each billing month and unused minutes do not roll over unless stated at sign-up.
We may change prices with at least 30 days’ notice before your next billing period. Fees already paid are non-refundable except where the law requires.
Your responsibilities
- Give us accurate information about your business, services and prices, and keep it up to date. The assistant answers from what you provide.
- Tell your customers they may be talking with an automated assistant where required, and give any notices your state requires for recording calls or conversations.
- Get any consent the law requires before you send your own marketing texts or calls to people who inquire, including under the Telephone Consumer Protection Act (TCPA) and state laws.
- Keep your login details secure and tell us about any unauthorized use.
- Use the service lawfully and not to send spam, collect sensitive data you do not need, or mislead anyone.
AI output
The assistant generates responses automatically. It can make mistakes. Review important details, such as prices, availability and bookings, before you rely on them. The calculator and any examples on our site are illustrative estimates, not promises of results.
Your data and ours
You own the information you give us and the inquiries delivered to you. You allow us and our providers to use it to run, secure and improve the service, as described in our Privacy Policy. We own the Zaleeka name, site and service, and the underlying platform belongs to its provider.
Third-party services
Integrations such as Google Calendar, CRMs, Zapier, n8n and messaging carriers are provided by third parties under their own terms. We are not responsible for their availability or actions.
Disclaimers
The service is provided “as is” and “as available”. To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee any number of inquiries, jobs or revenue.
Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or lost profits or revenue. Our total liability for any claim is limited to the fees you paid us in the 3 months before the claim arose.
Indemnity
You will defend and indemnify us against claims arising from your content, your use of the service, or your breach of these terms or the law, including messaging and recording laws.
Ending the service
You can stop at the end of the pilot or cancel a plan with effect from the end of the current billing month. We may suspend or end access for non-payment, misuse or legal risk. Sections that by their nature should survive will survive.
Governing law
These terms are governed by the laws of the state named in your order form or, if none, the State of Delaware, without regard to conflict-of-law rules. Courts in that state have exclusive jurisdiction, except that either party may seek urgent relief anywhere.
